WATERLOO TURF, LLC TERMS & CONDITIONS
WATERLOO TURF, LLC (“Waterloo Turf”) agrees to install, and Customer agrees to purchase artificial turf installation services (“Work”) on the Customer’s property (“Property”) in accordance with the specifications set out in the quote (“Quote”) attached hereto. SIGNING OF THE QUOTE BY CUSTOMER ESTABLISHES A BINDING AGREEMENT BETWEEN THE PARTIES.
If Customer does not provide a signed copy of the Quote to Waterloo Turf within thirty (30) days of the Quote date, the Quote will be considered void and invalid, and Customer must acquire a new Quote from Waterloo Turf.
CUSTOMER’S AND WATERLOO TURF’S DUTIES AND OBLIGATIONS
Customer and Waterloo Turf agree that this Agreement and all obligations of the parties hereunder shall be governed by the following Terms and Conditions:
PRICING AND PAYMENT
- Customer agrees to pay for the Work in accordance with the Pricing and Payment terms
- Payment: 50% of the total amount is due in order to schedule your The remaining 50% will be due at completion following our final walk through.
- All payments shall be made in cash, check or ACH Bank
- Credit Card payments are subject to a 25% CC Fee.
- Returned checks will be subject to an NSF charge of $50 plus interest at the highest monthly rate allowed.
- Customer understands and agrees that Waterloo Turf may file a lien against Customer in the event of non-payment.
CUSTOMER PAYMENT OBLIGATIONS
- In the event payments are not made as required, Waterloo Turf may, in its sole discretion, cease all Work until payment is received.
- If Customer is delinquent, interest of 5% monthly (18% per annum) will accrue on unpaid balances.
- If completion of the Work is delayed by causes under Customer’s control (including non-payment or failure to acquire HOA approval) for more than 15 days, Customer agrees to pay any increased labor, material, and equipment cost, and will be responsible for damages incurred by Waterloo Turf.
OBLIGATIONS OF CUSTOMER
- Customer is solely responsible for acquiring HOA or variance approvals and paying any HOA permits/fees. Waterloo Turf shall not be responsible for HOA restrictions or impervious cover restrictions.
- Customer will provide adequate access to the If access through adjacent properties is required, Customer must secure permission and hold Waterloo Turf harmless.
- Customer must disclose the existence of animals (gophers, moles, ). Waterloo Turf will not be responsible for turf damage caused by animal activity.
- Customer must prohibit anyone other than Waterloo Turf’s installation team from entering the Work site during installation.
- Turn Sprinklers Off: It is important that the ground is dry on the Project Start Date (PSD). Please turn off sprinklers for at least 3 days prior. If the ground is wet on the PSD, the Project may be rescheduled at Customer’s added expense.
- Lines of Communication: All changes or concerns must be directed to the assigned Waterloo Turf project manager
- Preparatory Work (Commercial Projects): Waterloo Turf recommends you have all site preparatory work completed by your third-party contractor at least 3 workdays prior to PSD. This includes moving irrigation, constructing retaining walls/curbs, and relocating electrical lines.
- Measure Twice, Cut Once: If turf must be re-seamed due to other contractors’ errors (e.g., uncapped irrigation), Waterloo Turf is not responsible. Customers must ensure prep work is complete in advance.
OBLIGATIONS OF WATERLOO TURF
- Waterloo Turf will carry general liability
- Work will be performed in a good and workmanlike
- Waterloo Turf does not guarantee completion by a specific date but will work diligently to complete the project.
LIABILITY
Waterloo Turf Co. will not be held liable in any way for reflective burn, ground water, delays caused by material shortages, or damage to underground utilities.
LOW-E WINDOWS
Please note that the reflection from Low-E windows can and will melt or burn artificial turf. It is in our best interest to advise you of these risks and to assess your windows as the Waterloo Turf warranty does not cover turf damage caused by Low-E Windows. We have found the best solution for this problem is to have Solar Screens or a Window Tint installed PRIOR to your turf installation. It is homeowners responsibility to cover windows that are/might potentially be reflective prior to install.
THERMAL EXPANSION/CONTRACTION
Synthetic turf expands and contracts when subjected to changes in temperature due to the product’s rubber backing causing wrinkles. Most materials expand when they are heated, and contract when they are cooled—the same goes for artificial turf. The expansion and contraction of synthetic turf is normal and will typically occur during warmer/colder weather. We make note of this as it is a common question we get during the summer months.
LIMITED WARRANTIES AND EXCLUSIONS
UPON FULL PAYMENT AND COMPLIANCE WITH THIS AGREEMENT, WATERLOO TURF PROVIDES A LIMITED WARRANTY THAT THE WORK WILL BE FREE FROM DEFECTS IN WORKMANSHIP FOR A PERIOD OF THREE (3) YEARS FROM COMPLETION.
Exclusions:
- Waterloo Turf Warranty Exemptions: Fabrication and Installation 3-Year Warranty does not cover damage created by humans and/or pets.
- Damage to utilities, septic systems, driveways, irrigation, pools, trees, or
- Issues caused by drainage, weather (hail, hurricanes, tornadoes), shrinking/melting from heat or reflection.
- Turf matting due to heavy traffic or
- Turf seams not guaranteed to be
- Expansion/contraction causing ripples or
- Turf color/denier variations from batch to
- Staining, cracking, or shifting of pavers/leuder
- Weeds (weed barrier reduces but does not eliminate growth).
- Any work performed by third
Additional Clauses:
- Project Changes: Changes to dimensions, scope, or materials after invoice approval are subject to additional charges and may affect PSD.
- Turf Only: Waterloo Turf is only responsible for issues related to the turf work described in the invoice.
- HOA/Impervious Cover: Waterloo Turf is not responsible for HOA/impervious restrictions. Customers should confirm approval before installation.
- Drainage: Waterloo Turf is not a drainage company and is not responsible for existing drainage issues. Waterloo Turf will follow existing grade with only minor adjustments.
- Not Responsible for Third-Party Work: Waterloo Turf assumes no responsibility for third-party contractors (irrigation, walls, prep).
- Pool Prevention: Waterloo Turf will use reasonable efforts to prevent dirt entering pools, but is not responsible for pool damage. Customers should cover pools.
- Weed Barrier: We recommend weed barrier fabric, but weeds may still
- Turf Matting: If matting occurs, Waterloo Turf can re-infill and power broom turf for a service fee.
- Unforeseen Problems: Hidden issues (underground irrigation, electrical, tree roots/stumps) may cause delays and require additional charges.
- Warranty Visits: Within 90 days after completion, service visits are After 90 days, a $250 service fee applies for non-covered issues.
FORCE MAJEURE
Waterloo Turf shall not be liable for failure or delay caused by events beyond its control (acts of God, labor disputes, shortages, equipment failure, etc.).
DAMAGE TO WORK
If Work already performed is damaged by causes beyond Waterloo Turf’s control, Customer must pay for labor and materials already completed, plus 25%.
MISCELLANEOUS
- Binding Effect: Agreement is binding on heirs, successors, and
- Severability: If one clause is invalid, the rest remain
- Entire Agreement: This document is the full No verbal promises apply.
- Amendments: Any changes must be in writing and
- Debris Removal: Waterloo Turf will remove its debris and leave premises reasonably
- Cancellations: The sale is Customer may not cancel once the deposit is accepted. If Waterloo Turf cancels before work begins, the deposit will be refunded.
